By making a booking with Marcus Bailey (The Artiste), you (The Client) agree to the following terms and conditions:
1. Booking Process
1.1. A date requested by The Client is provisionally held by the Artiste provided that a 50% deposit has been paid and
cleared.
1.2. Dates will be held with the deposit payment.
1.3. The full deposit is payable within 7 Days of the booking date, allowing a 7 day cooling off period.
1.4. The Client agrees to pay the full outstanding balance 30 days before the event.
1.5 . Any date booked by The Client which is within 40 days of the booking form submission date, a full payment will be required
within 7 days of the booking date.
2. Cancellation
2.1. Cancellations must be mutually agreed and acknowledged with The Artiste before they can be accepted.
Cancellations cannot be accepted via answer service, or via a third party.
Cancellation by The Client
2.2. The cancellation fee is subject to The Artiste's duty to mitigate any loss by accepting other work for the
same date.
2.2.1. Cancellation over 6 months prior to performance – 25% of agreed fee
2.2.2. Cancellation between 3 and 6 months prior to performance – 50% of agreed fee.
2.2.3. Cancellation under 3 months prior to performance – 100% of agreed fee.
Cancellation by The Artiste
2.3. In the unlikely event that the Artiste is unable to deliver the agreed service of entertainment, the
Artiste shall endeavour to provide an entertainer, of equal standing to the Artiste, to serve as a
replacement. Should this not be possible, all monies paid by the Client shall be returned. Following the
reimbursement of these funds, the Artiste shall have no further liability to the Client in relation to any
part of the Contract.
2.4. In the case of non-attendance by the Artiste without prior cancellation, unless this is due to injury,
illness or mechanical breakdown or accident (evidenced by a doctor's note or AA / garage note), or any
force majeure The Artiste shall pay The Client a penalty amount of 50% of The Artiste's fee.
2.5. There is also the opportunity to have any monies roll over to another event of your choice subject to
availability
3. Insurance
3.1. The Artiste warrants that all necessary steps have been taken to ensure that all agreed activities are
covered by Public Liability Insurance, with an indemnity limit of £5million.
3.2. The Client agrees that no demands will be made of The Artiste to undertake actions which would not
be covered by such insurance.
4. Additional Fees/Conditions
4.1. Any travel over 35 miles may incur extra fees, and if necessary, accommodation fees at The Artistes
discretion.
4.2. Payments not paid on time incur statutory interest of 8% + Bank of England base rate
5. Assumptions
5.1. In the event that any Act is unable to complete a performance due to a delay in the start of the
performance schedule, where such delay is no fault of the Act, the Client shall remain liable to pay the
full Fee due.
6. Any variations to the agreed performance, including but not limited to duration and act material, must
be agreed in writing prior to the performance.
This agreement is governed by the law of England and Wales, and is subject to the exclusive jurisdiction of the courts of England and Wales.
